Indian court orders deportation of two Nigerians

The Karnataka High Court has directed immigration authorities to deport two Nigerian nationals accused of staying in India for more than ten years without valid visas.
The court issued the directive in a ruling delivered on Thursday.
Authorities from the Foreigners Regional Registration Office were instructed to begin deportation procedures for Emeka Iwoba, also known as Austin Noso Iwoba, and Uderike Fidelis.
The two Nigerians were arrested in 2024 by police in Bengaluru over allegations of trafficking narcotics.
The substances reportedly involved in the case included the synthetic drug MDMA and cocaine.
During the legal proceedings, the suspects argued that they were not properly informed of the reasons for their arrest by law enforcement officials.
In its judgement, the court ordered their release from custody.
The court stated that authorities must always inform suspects about the reasons for their arrest as required under constitutional safeguards.
According to the ruling, this requirement is a fundamental constitutional protection rather than a mere procedural formality.
The court also noted that the protection provided under Article 22 of the Constitution of India applies to everyone within the country’s jurisdiction.
It further explained that the constitutional guarantee is person-centred rather than citizen-centred.
Following their release, the court directed the Foreigners Regional Registration Office to proceed with their deportation according to the government’s standard procedures.
