Supreme Court Ends Oyebanji’s Legal Battle Over Ekiti Victory

The Supreme Court has dismissed the challenge against Governor Abiodun Oyebanji’s nomination as the All Progressives Congress (APC) candidate for the Ekiti governorship election, clearing the final legal hurdle surrounding his emergence as the party’s flag bearer after he had already secured victory at the poll.

The apex court, in its judgment delivered in Abuja, affirmed the earlier decision of the Court of Appeal which upheld Oyebanji’s nomination and dismissed the appeal filed by APC aspirant Abimbola Olawumi, who had challenged the process that produced the governor as the party’s candidate.

Olawumi had approached the court over allegations surrounding the APC governorship primary, seeking to nullify Oyebanji’s nomination and questioning the circumstances surrounding her participation in the party’s selection process.

The Supreme Court held that the appeal lacked merit and upheld the lower court’s decision, ruling that the legal challenge could not invalidate Oyebanji’s candidacy.

Oyebanji had earlier been declared winner of the Ekiti governorship election by the Independent National Electoral Commission (INEC), securing another term in office after defeating his challengers at the poll.

The latest judgment therefore does not determine the outcome of the election but settles the separate pre-election dispute over whether Oyebanji was validly nominated by the APC to contest the election.

The ruling is expected to bring an end to the prolonged legal battle over the APC ticket and further strengthen Oyebanji’s position as he continues his administration in Ekiti State.
