Court Orders INEC to Deregister ADC, Accord, Three Other Parties

The Federal High Court in Abuja has ordered the Independent National Electoral Commission (INEC) to deregister the African Democratic Congress (ADC) and four other political parties for failing to meet constitutional requirements for continued registration.
The affected parties include the Action Peoples Party (APP), Action Alliance (AA), Accord Party (AP), and the Zenith Labour Party (ZLP), following a judgment delivered by Justice Peter Lifu.
“The court has directed INEC to deregister the listed political parties in line with constitutional provisions governing party registration and performance thresholds,” the ruling indicated.
The case was instituted by the National Forum of Former Legislators in suit number FHC/ABJ/CS/2637/2026, which asked the court to determine whether INEC is constitutionally required to remove parties that fail to meet minimum electoral performance standards.
The plaintiffs argued that the affected parties had consistently failed to meet the requirements outlined in Section 225A of the 1999 Constitution (as amended) and provisions of the Electoral Act 2022.
They maintained that political parties are expected to secure a minimum level of electoral success, including winning a percentage of votes in presidential elections or obtaining at least one elective position at various levels of government.
The former lawmakers further argued that the ADC and the other listed parties performed poorly in the 2023 general elections and subsequent by-elections, failing to secure representation at key levels of governance.
They contended that the continued recognition of such parties undermines the credibility of Nigeria’s electoral system and urged the court to compel INEC to act.
The court subsequently ruled that INEC is constitutionally obligated to deregister political parties that do not meet the stipulated electoral thresholds.
The judgment also ordered the electoral commission to implement the deregistration ahead of preparations for the 2027 general elections.
