Senate Moves To Bring Facebook, TikTok Under Nigerian Laws

The Nigerian Senate has advanced a bill seeking to compel global social media companies, including Facebook, TikTok and other major digital platforms operating in the country, to establish physical offices in Nigeria as part of efforts to strengthen accountability and regulation within the digital space.

The proposed legislation, sponsored by Senator Ned Nwoko representing Delta North, seeks to amend the Nigeria Data Protection Act, 2023, by mandating social media platforms operating in Nigeria to maintain physical offices within the country’s territorial boundaries.

The bill was considered during a public hearing organised by the Senate Committee on ICT and Cyber Security, where stakeholders expressed support for the proposal, arguing that multinational technology companies should have a stronger presence and accountability mechanism in Nigeria.

Supporters of the bill said requiring platforms such as Facebook, TikTok, Instagram, X, WhatsApp and other online service providers to establish local offices would improve engagement with Nigerian authorities, strengthen data protection measures and provide easier channels for addressing complaints from users.

Senate President Godswill Akpabio, who was represented at the hearing, said the proposal was not designed to hinder the operations of social media companies but aimed at promoting accountability, compliance with Nigerian laws and better interaction between digital platforms and the country.

Chairman of the Senate Committee on ICT and Cyber Security, Senator Shuaib Salisu, said the bill formed part of broader legislative efforts to strengthen Nigeria’s digital economy, improve cybersecurity and create a more responsible online environment.

However, some stakeholders raised concerns over possible consequences of the legislation, warning that strict requirements could discourage investment or force some technology companies to reconsider their operations in Nigeria.

Critics also argued that any regulation affecting digital platforms must carefully balance national security and consumer protection with the need to preserve freedom of expression and innovation in Nigeria’s growing technology sector.

The proposed amendment comes amid increasing global efforts by governments to regulate major technology companies over issues including data privacy, misinformation, online safety and corporate responsibility.

If passed into law, the bill would require social media platforms operating in Nigeria to maintain a verifiable physical presence in the country, making it easier for regulators and users to engage with the companies on issues relating to compliance and accountability.
